1. About the App

Pancakes Flashcards is an AI-powered spaced repetition learning tool. It allows users to create, organize, and study flashcard decks, with AI-assisted card generation from text, documents, images, presentations, and (on paid plans) videos. The app uses the FSRS (Free Spaced Repetition Scheduler) algorithm to optimize study schedules based on individual retention patterns.

2. Accounts

To use Pancakes Flashcards, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access at support@usepancakes.com.

Age requirement: You must be at least 13 years old to use the app. If you are located in the European Union or European Economic Area, you must be at least 16, or have verifiable consent from a parent or legal guardian. We do not knowingly collect data from users below these ages and will delete any such account upon discovery.

3. Subscription Plans and Pricing

Pancakes Flashcards is offered under the following subscription tiers, billed monthly:

All plans include unlimited storage. The primary difference between plans is the quality of the AI model used for card generation and access to advanced features.

All paid subscriptions are processed through Lemon Squeezy, which acts as the Merchant of Record. By subscribing, you also agree to Lemon Squeezy's terms of service.

Cancellations: You may cancel at any time. Your plan remains active until the end of the current billing period. No partial refunds are issued for unused time.

Refunds: We offer refunds within 7 days of the initial purchase. Contact us at support@usepancakes.com to request one.

EU consumers — right of withdrawal: If you are a consumer in the European Union or European Economic Area, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason. By starting to use paid features immediately after purchase, you expressly request that we begin providing the service during the withdrawal period and acknowledge that you lose your right of withdrawal once the service has been fully performed. Price changes: We may change subscription prices with at least 30 days' notice by email. Price changes take effect at your next renewal. If you do not agree to the new price, you may cancel before the change takes effect.

5. User Content and Ownership

You retain full ownership of all content you create or upload within the app, including flashcard decks, folders, and uploaded files. Your content is stored in our cloud database and file storage solely for the purpose of providing the service to you.

We do not claim ownership over your content and we do not use your content to train our own AI models. Content sent to third-party AI providers for card generation is governed by Section 6 and by those providers' own terms.

6. AI-Powered Features

Card generation features send the content you provide (document text, image content, video transcripts) to third-party AI providers for processing. By using AI-powered features, you acknowledge that your content is processed by:

• Groq — for Free plan card generation
• Google Gemini — for Pro and Premium plan card generation

These providers process your content under their own privacy policies. We do not store the raw input sent to AI providers beyond what is necessary to return results to you. You are responsible for ensuring that any content you submit for AI processing does not include sensitive personal data belonging to third parties.

7. Uploaded Files

The app supports uploading PDFs, images, .docx, .pptx files (all plans) and videos (Pro and Premium). Uploaded files are stored in Cloudflare R2 and accessed via signed, time-limited URLs. Files are used solely to generate flashcard content and are retained for the duration of your account. Upon account deletion, uploaded files are removed according to Section 9.

You are responsible for ensuring you have the right to upload and process any files you submit. Do not upload files containing sensitive personal data belonging to others or content you do not have the right to use.

8. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Upload files containing malware, illegal content, or content that violates third-party rights
• Attempt to reverse-engineer or extract the source code of the app
• Abuse or overload the app's infrastructure
• Use automated scripts to interact with the app in ways not explicitly permitted
• Submit content belonging to others without appropriate rights or consent

We reserve the right to suspend or terminate accounts that violate these Terms.

Where reasonably possible, we will notify you by email of any suspension or termination and give you a reasonable opportunity to respond, unless the violation is severe, ongoing, or requires immediate action to protect the service or other users.

9. Account Deletion and Data Retention

You may delete your account at any time from within the app settings. Upon deletion, all your personal data, flashcard content, and uploaded files will be permanently deleted within 7 days. This action is irreversible.

Residual copies may persist in encrypted backups for up to 30 days before being overwritten.

Billing records may be retained for longer where required by law or financial regulations.

10. Intellectual Property

The Pancakes Flashcards app, its design, codebase, and branding are the intellectual property of Pancakes. You are granted a limited, non-exclusive, non-transferable license to use the app for personal or internal study purposes. You may not resell or sublicense access to the app.

11. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind. AI-generated flashcard content may contain inaccuracies. We do not warrant that generated cards will be error-free or suitable for any specific educational purpose. Always review AI-generated content before relying on it for study.

12. Service Availability

We do not guarantee uninterrupted or error-free access to the app. We may perform maintenance, updates, or temporarily suspend the service without prior notice. We will make reasonable efforts to minimize disruption and to communicate planned downtime in advance where feasible.

13. Limitation of Liability

To the fullest extent permitted by law, Pancakes shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total aggregate liability for any claim arising out of or relating to these Terms or the app shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim, or (b) USD 50.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer protections in your country of residence.

14. Changes

We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before they take effect. Continued use of the app after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription and delete your account before they take effect.

15. Governing Law and Disputes

These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the competent courts in Amman, Jordan.

If you are a consumer resident in the European Union, European Economic Area, or United Kingdom, this clause does not deprive you of the protection of mandatory consumer law provisions of the country in which you reside, and you may also bring proceedings in the courts of your country of residence.
